Thomas B. Helbig, Jr. represents companies, insurers, and institutions in complex litigation involving contracts, business torts, healthcare, and employment issues. He represents clients in state and federal courts at both the trial and appellate levels, leveraging his federal appellate clerkship experience to strengthen strategy, briefing, and motion practice.

Legal Experience That Stands Out

Tom handles a broad range of matters, with particular experience in commercial contract and business tort disputes, restrictive covenant and trade secret litigation, healthcare and ERISA-related claims (including allegations involving billing practices, fraud theories, and coverage/payment disputes), employment litigation, and civil rights matters involving private educational institutions. He has represented both employers and employees, as well as private and public corporations and other organizations navigating complex legal and operational risk.

Before joining the firm in 2016, Tom clerked for the Hon. Thomas I. Vanaskie of the U.S. Court of Appeals for the Third Circuit, where he assisted with research and opinion drafting in significant federal appellate matters. In law school, he served as Research Editor for the Temple Law Review and worked as a research assistant on scholarship addressing topics including artificial intelligence in the legal industry, financial regulation, and behavioral finance. While earning his M.B.A., Tom participated in the Global Immersion program in China, studying in Beijing, Shanghai, and Wuhan, and had a management consulting externship with the International Finance Corporation. Those experiences inform his practical, business-minded approach to litigation.

 

Representative Matters

  • Represented a steel manufacturer in an asbestos action in the Philadelphia Court of Common Pleas. Obtained dismissal of all claims after the court sustained preliminary objections based on corporate dissolution and lack of successor liability.
  • Represented a logistics and warehousing company and its principal in a multimillion-dollar breach of contract case in California. Secured a walk-away resolution with mutual releases and no payment required.
  • Plaintiff and appellate counsel to a private equity company in a breach-of-contract and fraudulent transfer actions relating to the sale of its interests in a specialty finance company, in which the United States District Court for the Eastern District of Pennsylvania granted summary judgment in favor of plaintiff and entered a multimillion-dollar judgment, which was upheld by the United States Court of Appeals for the Third Circuit.
  • Defense and appellate counsel to a private residential boarding school in several related actions alleging that the school’s enrollment and housing policies violated the Americans with Disabilities Act and Fair Housing Act, in which the United States District Court for the Middle District of Pennsylvania granted summary judgment in favor of the school in all cases, which were upheld by the United States Court of Appeals for the Third Circuit.
  • Defense and appellate counsel to a health insurer in an action brought by multiple private emergency medical practices, in which the trial court granted a motion to dismiss with prejudice, which was upheld by the state appellate court.
  • Defense counsel to national residential real estate company in an action brought by former agent in which the trial court granted a defense motion to compel arbitration, and in an action relating to an alleged breach of an agreement of sale in which the trial court granted summary judgment in defendant’s favor.
  • Appellate counsel to a bi-state agency in an action brought by a disappointed bidder, in which the Third Circuit vacated the District Court’s order granting summary judgment to the disappointed bidder and ordered the District Court to dismiss the case with prejudice.
  • Appellate counsel to a packaging machinery supplier and distributor in the United States Court of Appeals for the Third Circuit, in which the Third Circuit reversed the District Court’s grant of a new trial and reinstated a multimillion-dollar jury verdict for breach of contract.
  • Defense counsel to an international video surveillance and systems technology company in an employment dispute, in which the court granted preliminary objections and dismissed the case with prejudice for lack of personal jurisdiction.
