Secured Dismissal of Asbestos Claims Against PTC Alliance

Case Result

Elliott Greenleaf’s Brian Grady and Thomas Helbig represented PTC Alliance Corp. and PTC Alliance LLC in an asbestos action filed in Philadelphia Court of Common Pleas by a former employee. The plaintiff initially named PTC Alliance Corp. as a defendant; however, the court sustained our preliminary objections and dismissed all claims, finding that the corporation had been dissolved years earlier and therefore could not be sued.

The plaintiff then amended the complaint to add PTC Alliance LLC, alleging successor liability. We again filed preliminary objections, and the court dismissed the claims against the LLC as well, holding that the plaintiff never worked for that entity and had failed to plead facts sufficient to support a successor liability theory.
