Legal Experience That Stands Out

Our Education Team is experienced in the diverse legal (civil and criminal), and administrative issues facing the higher education community as well as public and private elementary and secondary schools.

Who We Stand Behind

Our clients include education institutions throughout the United States.

How We Take a Stand

We represent and counsel clients in a wide variety of matters including:

  • Title IX investigations of alleged sex and gender-based harassment, Title IX litigation, and Title IX training
  • Student conduct administrative hearings
  • FERPA matters
  • Discrimination claims
  • Privacy issues
  • Clery Act compliance
  • University policy compliance and implementation of best practices
  • Records retention
  • Student and/or employee misconduct on campus
  • Documenting and investigating complaints about misconduct
  • Security issues on campus
  • ADA issues on campus

Our attorneys are highly experienced in developing, training on, and implementing processes to handle reports of campus sexual misconduct to minimize an institution’s exposure to liability stemming from allegations of noncompliance with Title IX, Clery Act, and other theories of liability asserted by private litigants, while at the same time respecting the rights of individuals involved in allegations of sexual misconduct, and advancing and protecting the interests of the school community at large.

Our firm also serves as external investigator for alleged Title IX violations or complaints regarding sexual assault, harassment, and gender-based violence on campus. We work directly with senior administration to conduct interviews, gather and review evidence, and issue appropriate findings. In addition, Elliott Greenleaf defends educational institutions in investigations by the U.S. Department of Justice, Office of Civil Rights, and in litigation, if necessary.
