On July 30, 2020, the U.S. Court of Appeals for the Third Circuit vacated the District Court’s judgment against Elliott Greenleaf’s client, the Delaware River Port Authority (“DRPA”), and directed that a disgruntled bidder’s case be dismissed.
The Third Circuit had previously agreed with Elliott Greenleaf, and vacated the District Court’s injunction that would have required the DRPA to award a contract to the disgruntled bidder. Thomas J.
