Third Circuit Court of Appeals Directs Dismissal of Case Against Elliott Greenleaf’s Client

On July 30, 2020, the U.S. Court of Appeals for the Third Circuit vacated the District Court’s judgment against Elliott Greenleaf’s client, the Delaware River Port Authority (“DRPA”), and directed that a disgruntled bidder’s case be dismissed.

The Third Circuit had previously agreed with Elliott Greenleaf, and vacated the District Court’s injunction that would have required the DRPA to award a contract to the disgruntled bidder. Thomas J. Elliott (argued), Stewart J. Greenleaf, Jr., Thomas Jackson Elliott and Thomas B. Helbig represented the DRPA.
