The Pennsylvania Superior Court affirmed a Philadelphia Court of Common Please Judge’s 2018 decision to grant the Iron Order Motorcycle Club’s compulsory nonsuit motion at the conclusion of Plaintiff’s case in chief to the jury. Brian Grady of Elliott Greenleaf represented the Motorcycle Club both at trial and on appeal. In 2018, the Philadelphia Court of Common Please granted the Iron Order Motorcycle Club’s Motion for Compulsory Nonsuit finding that Plaintiff failed to offer admissible evidence that would establish the motorcycle club’s liability. On appeal, the Superior Court agreed with the trial court, stating: “we agree with the trial court that appellant was unable to establish a cause of action against” the motorcycle club. This matter was tried before a jury in Philadelphia County. Colin J. O’Boyle, Aimee L. Kumer, Thomas B. Helbig and Steven C. Tolliver, Jr. also worked towards the successful resolution of this matter at trial and on appeal.
