Elliott Greenleaf Wins Third Circuit Affirmation of Trial Verdict and Limitation on Damages

Representing the Defendant City of Dubois at trial and on the briefs on appeal, Elliott Greenleaf won affirmation of a trial verdict in RHJ Medical Center, Inc. v. City of Dubois, Fed. Appx., 2014 U.S. App. LEXIS 7679. The Third Circuit affirmed the City’s denial of a permit for a proposed methadone clinic, and rejected Plaintiff’s allegations under the 14th Amendment, Americans with Disabilities Act and Rehabilitation Act. After a bench trial, Judge Kim Gibson of the United States District Court for the Western District of Pennsylvania entered judgment for the City on five of the Plaintiff’s six claims, and limited the damages award on the sixth claim because the Plaintiff failed to mitigate its damages.
