Stuart S. Smith is a senior trial attorney with substantial experience litigating complex cases in state and federal courts with an emphasis on commercial disputes, insurance coverage, personal injury, toxic torts, healthcare, real estate, and products liability. He has served as trial counsel and lead trial counsel in litigating, to a successful conclusion, multimillion-dollar cases for a diverse range of business clients including product manufacturers, construction companies, dry cleaners, franchisees, and professional practices.

Stuart also represents clients in complex matters before the American Arbitration Association and numerous other alternative dispute resolution forums. He has served as an arbitrator in Delaware County and Montgomery County.

Stuart previously served on the Professional Liability Committee of the Pennsylvania Bar Association and as a Delegate on behalf of the Pennsylvania Bar Association to the American Bar Association’s House of Delegates. He served as President, Vice-President, Secretary, and Treasurer of the Delaware County Bar Association’s Young Lawyers Division.

Stuart is a veteran of more than 49 marathons and 50Ks in 44 states and Washington, D.C.

Representative Matters

  • Won a court order removing an executor of an $11 million estate and related trust where the executor failed to take substantive action to administer the estate or make distributions.
  • Successfully litigated and settled an insurance coverage dispute securing coverage for a multimillion-dollar commercial claim.
  • Won a summary judgment on behalf of a church in real estate litigation involving a builder’s contractual obligation to provide improvements to church property valued at more than $1.8 million.
  • Successfully litigated claims and achieved a seven-figure settlement on behalf of a minor victim of sexual assault and her parents.
  • Successfully litigated multimillion-dollar personal injury toxic tort claims arising from exposure to dry cleaning solvents.
  • Successfully litigated insurance coverage claims concerning soil and water contamination by dry cleaning solvents.
