After a five-day trial, a Bucks County jury returned a verdict in favor of Elliott Greenleaf’s clients, owners of a farm condemned by Lower Makefield Township for construction of a golf course. The jury found the landowners were entitled to $5,850,000, plus accrued interest, for a total verdict in excess of $7,000,000. This verdict ranks among the largest in Bucks County land condemnation history.
In awarding approximately double than Township’s offer at the time of the condemnation, the jury found that the Township “hurried” the condemnation to eliminate the landowners’ ability to sign an agreement with a developer at a much higher value. Elliott Greenleaf presented evidence that the Township knew the landowners were negotiating with the developer at the same time, and won multi-million dollar damages through proof of the escalating real estate market at the time and the “hurried” condemnation in light of the developer’s agreement that demonstrated significant value, if the condemnation was found invalid.
