COURT APPROVES POST-JUDGMENT CLASS ACTION SETTLEMENT FOR PLAINTIFF CLASS

Elliott Greenleaf’s motion to approve a post-judgment class action settlement in the Whitehead v Vacation Charters was granted by the Court, who noted that Elliott Greenleaf provided “extraordinary work” to benefit the Class. Elliott Greenleaf’s Timothy T. Myers and Mark A. Kearney were court-approved class counsel for the class of employees working for Vacation Charters who obtained declaratory, injunctive and monetary relief through a May 18, 2011 Judgment following a full trial in January 2011. Under the court-approved settlement, class members received declaratory relief that they were “employees” during the class period and their “independent contractor agreements” were null and void. In addition, any employee owed wages through “holdbacks” or “chargebacks” will receive payment from a settlement fund established to pay these wages.

Shareholders Timothy T. Myers and Mark A. Kearney represented the class throughout the litigation, trial, post-trial and class settlement.
