We have extensive experience in successfully litigating contractual disputes between health insurance companies and medical care providers, including those involving risk sharing arrangements, capitation agreements, the terms of hospital and physician contracts and disputes over physician credentialing. We have participated in the defense of many class actions challenging the legality of managed care practices, and managed care billing and payment methodologies, including complex matters coordinated through the federal Multi-District Litigation Panel.

We have successfully litigated claims on behalf of our healthcare clients involving disputes over the valuation, sale and acquisition of regional health maintenance organizations, preferred provider organizations, provider groups and physician practices. We have acted as counsel to managed care organizations in efforts to recover debts in the context of bankruptcy proceedings, as well as defending such companies in bankruptcy court adversary actions.

We have also achieved significant results for our healthcare clients in a variety of other matters such as those involving administrative service arrangements with self-funded, employer sponsored medical benefits plans; disputes over broker fees and commissions; litigation concerning the relative rights and obligations under coordination of benefits provisions; challenges to the scope of claims audits, claim audit methodologies, and auditor qualifications; and claims of unfair competition. Our attorneys possess extensive practical experience in counseling clients, and litigating claims relating to rights and obligations under ERISA in connection with the administration of medical benefits.
