Elliott Greenleaf Wins Defense Verdict for Developers in Seven-Figure Lawsuit
The Honorable Arthur J. Tilson of the Court of Common Pleas of Montgomery County recently entered judgment, following trial, in favor of Elliott Greenleaf's client by denying recovery to the owner of a shopping center for the alleged failure of Elliott Greenleaf's client to construct a lead store in the shopping center. Greylock Arms, Inc. v. Harvey E. Kroiz, Irwin Kroiz, Harvey E. Kroiz and Irwin Kroiz, t/a Republic Airport Road Partnership, and Triangle Building Supplies & Lumber Co., Court of Common Pleas of Montgomery County, Pennsylvania.
Plaintiff, an owner of a shopping center located in Allentown, Pennsylvania, contended that Defendant Republic had agreed to build a large home and building center store in the shopping center and had knowingly and fraudulently manipulated its way out of the deal, causing high seven-figure losses.
The case presented intricate legal and factual problems integrating economics, land use law, contract law, and unusual and novel tort issues. After succeeding in having Judge Tilson determine there was no ambiguity in the original agreement between the parties, the case then focused on testimony of Greylock's principal, followed by a parade of experts on behalf of Greylock. Elliott Greenleaf, teaming with Blank Rome Comisky & McCauley, demonstrated through cross examination of the Plaintiff's fact and expert witnesses, that there was no claim for damages.
