Third Circuit Affirms Elliott Greenleaf' Arguments in Support of Dismissal of Claims in Title VII Case
On November 8, 2004, the United States Court of Appeals for the Third Circuit affirmed the May 16, 2002 Order and Opinion of the Honorable J. Curtis Joyner of the United States District Court for the Eastern District of Pennsylvania granting Elliott Greenleaf' motions for summary judgment on claims of gender, race, religious and national origin discrimination under Title VII and the Pennsylvania Human Relations Act. (Shramban v. Aetna, et al., 3d Cir., No. 03-2742, 11/8/04).
On behalf of the employer, Elliott Greenleaf had moved for summary judgment on all claims, which the District Court granted. On appeal, the Third Circuit found that Plaintiff failed to demonstrate that she suffered intentional discrimination within the meaning of Title VII.
