Elliott Greenleaf OBTAINS INJUNCTION ENDING TEACHERS' WORK STOPPAGE
As widely reported in Northeastern Pennsylvania 's news media, on November 22, 2004, Elliott Greenleaf obtained an injunction ordering teachers back to the classroom. (Crestwood School District v. Crestwood Education Association, No. 95-E-2004 (C.C.P. Luzerne November 22, 2004)). After engaging in collective bargaining negotiations, the Crestwood Education Association, the organization representing Luzerne County's Crestwood School District 's professional employees, engaged in a strike commencing November 22, 2004. On behalf of the District, Elliott Greenleaf commenced an equity action and sought immediate relief in the Court of Common Pleas of Luzerne County on that same date. Elliott Greenleaf asserted that the union's strike was premature, illegal and prohibited under the Public Employee Relations Act ("PERA") because the union failed to comply with PERA's mandated substantive procedures prior to the work stoppage. Elliott Greenleaf further alleged that the District would suffer irreparable harm absent an Order forcing the teachers back to work. The Honorable Michael Toole agreed with Elliott Greenleaf and issued an Order immediately enjoining the work stoppage, and ordering the teachers back to work. Elliott Greenleaf shareholder John G. Dean represented the School District in this matter. |
