ELLIOTT GREENLEAF WINS SUMMARY JUDGMENT IN DELAWARE BID CONTEST

March 2008 - The Delaware Court of Chancery recently granted Elliott Greenleaf’s motion for summary judgment in its defense of a contractor in the first public works bid protest of its kind in decades. In Asphalt Paving Systems, Inc. v. Dept. of Transportation, et al., the State awarded a construction contract to the firm’s client, and rejected a disgruntled competitor’s bid for failing to comply with Delaware’s statutory submission requirements. In agreeing with Elliott Greenleaf, the Chancery Court refused to order the project to be rebid and ruled that Delaware’s public works contracting law is mandatory, not directory. The Court ordered the award to Elliott Greenleaf’s client could not be set aside.
