Elliott Greenleaf WINS DISMISSAL OF DISCRIMINATION IN HOUSING CLAIM

On behalf of Luzerne County, Elliott Greenleaf successfully defeated a well publicized claim that the County violated the Fair Housing Act by refusing to grant a zoning use variance to allow a group home for recovering alcoholics. Plaintiff alleged that Luzerne County improperly acceded to public pressure in reaching its decision. Following discovery, Elliott Greenleaf argued to the United States Department of Housing and Urban Development ("HUD") that Luzerne County's zoning ordinance is facially non-discriminatory and was applied in a non-discriminatory manner to this proposal by Luzerne County. HUD agreed with Elliott Greenleaf, and dismissed this discrimination claim against Luzerne County.
