ELLIOTT GREENLEAF SUCCEEDS IN REMOVING AN EXECUTOR OF MULTI-MILLION DOLLAR ESTATE IN ORPHANS’ COURT

Elliott Greenleaf recently won a court order removing the Executor of an $11 million estate and related trust in the Orphans’ Court of Montgomery County. Elliott Greenleaf successfully persuaded the Court that, since being granted Letters of Administration by the Register of Wills, the Executor failed to take substantive action to administer the estate or to make distributions. Further, Elliott Greenleaf’s arguments and evidence convinced the Orphans’ Court that the Executor mismanaged and wasted the estate and trust assets, and caused unreasonable delays in the performance of his fiduciary duties.

The Executor’s appeal to the Pennsylvania Superior Court was quashed when Elliott Greenleaf argued that the Orphans’ Court Order was not final and, therefore, the matter was not ripe for appeal. The Executor’s Motion for Reargument and/or Reconsideration was likewise rejected by the Superior Court. The Executor’s Petition for Allowance of Appeal was declined as untimely.
