Elliott Greenleaf Wins Summary Judgment For Borough And Its Officials In Wrongful Terminatino Case

August 2008 -In a wrongful termination case, Elliott Greenleaf won summary judgment for the Borough of Throop, its Mayor, Councilperson and Chief of Police in the United States District Court for the Middle District of Pennsylvania. The Court held that Elliott Greenleaf successfully established, among other things, that the plaintiff received all the process he was due under the United States Constitution.  (Viola v. Borough of Throop, et. al, United States District Court for Middle District of Pennsylvania).

In this federal civil rights case, Plaintiff claimed his Constitutional rights to due process were violated when the Borough suspended him without pay after a disciplinary hearing. The Firm persuaded the District Court that the Plaintiff suffered no deprivation worthy of the protection of the United States Constitution and, as such dismissed, Plaintiff’s federal claims against the Borough and its officials.
